§1 General

The deliveries, services and offers of springerle.net are exclusively based on these terms and conditions. These terms and conditions shall be deemed accepted upon receipt of the goods. Basis for all offers and orders with domestic and foreign customers is German law, and only the following terms of contract are applicable. In the following the following terms are valid:

§2 Offer and conclusion of contract

The product representations contained in the online store of Springerle.net do not constitute binding offers, but serve for the submission of a binding offer by the customer. The prices are gross final prices. Since the products are baked goods, there may be deviations in the weight specifications. Therefore, approximate weights are given. The pastry is pure handicraft, therefore we do not calculate with the pastry by weight but by piece and content. Each pastry is an individual item and may differ in appearance from the product images in the online store.

The customer can submit the offer by telephone, in writing, by fax, by e-mail or via the online order form integrated in the Springerle.net online store. When placing an order via the online order form, the customer, after entering his personal data and by clicking the button "order" in the final step of the ordering process, submits a legally binding contractual offer with regard to the goods contained in the shopping cart.

Springerle.net can accept the customer's offer by a written (letter) or electronically transmitted (fax or e-mail) order confirmation or by delivery of the goods within five days. Springerle.net is entitled to refuse acceptance of the order.

If the goods are not available, the customer will be informed immediately and any advance payment will be refunded without delay.

The order processing and contacting usually take place via e-mail and automated order processing. Additions, amendments and subsidiary agreements to the order must be expressly made in writing and can be transmitted via e-mail, fax or letter. The customer has to ensure that the e-mail address and other contact data provided by him for order processing are correct, so that e-mails sent by springerle.net can be received under this address. In particular, when using SPAM filters, the customer must ensure that all e-mails sent by springerle.net or by third parties commissioned by springerle.net to process the order can be delivered.

§3 Prices, payment and delivery terms

The stated prices of the seller are final prices and include the statutory German VAT. Any additional delivery and shipping costs are indicated separately via the shopping cart in the offer. Springerle.net delivers exclusively against prepayment. Preferred payment method is bank transfer or payment via the online payment system PayPal. Credit card payments and cash on delivery are not offered. Unless otherwise agreed or separately indicated on the article, we deliver within one week after receipt of payment. Deviating delivery dates or delivery periods, which are agreed binding or non-binding, must be in writing. Delivery and performance delays due to force majeure and due to events that make springerle.net the delivery significantly more difficult or impossible (eg strike, lockout, official orders and incorrect or delayed self-delivery by suppliers of the seller, etc.) springerle.net is not responsible even with binding agreed deadlines and dates. They entitle springerle.net to postpone the delivery or services for the duration of the hindrance plus a reasonable start-up time or to withdraw from the contract in whole or in part because of the unfulfilled part.

Deliveries outside the Federal Republic of Germany require prior written confirmation. E-mail correspondence is preferred.

Self-collection is not possible for logistical reasons.

§4 Shipping costs and shipping conditions

We offer staggered shipping costs for shipping within Germany. The shipping fee is EUR 4,90 up to a value of goods of 40,- EUR. From a value of goods of 40,- EUR the shipping within Germany is free of charge. Shipping to the countries of the European Union is only on written request. Shipping costs are charged per order. The shipping costs cover the actually incurred postage and freight, as well as partially the costs for packaging.

The delivery of goods is regularly carried out by shipping and to the delivery address specified by the customer. In the processing of the transaction, the delivery address specified in the order processing of the seller is decisive. Deviating from this, when selecting the payment method PayPal, the delivery address deposited by the customer with PayPal at the time of payment is decisive.

If the transport company sends the shipped goods back to springerle.net because a delivery to the customer was not possible, the customer bears the costs for the unsuccessful shipment. This does not apply if the customer exercises his right of withdrawal by refusing acceptance or if he was temporarily prevented from accepting the offered service, unless springerle.net had notified him of the service a reasonable time in advance.

§5 Transfer of risk

If the customer is a consumer, the risk shall pass to the customer upon delivery of the goods. If the customer is a merchant, the risk passes to him as soon as the shipment has been handed over to the person performing the transport or has left the warehouse of springerle.net for the purpose of shipment.

§6 Retention of title

Only after full payment of the goods, the ownership of the goods is transferred to the buyer.

§7 Data protection

For order processing it is necessary that springerle.net stores personal data. I

In accordance with the Federal Data Protection Act, the customer has the right to information, correction, blocking or deletion of his stored data at any time. If legal, contractual, commercial or tax retention periods or reasons prevent the deletion, the customer data will be blocked instead of deleted. We will be happy to inform you upon request.

Further notes on data protection

§8 Final provisions

No further promises have been made and no further agreements have been made. Unless otherwise agreed, the transfer of rights and obligations under this contract by the customer to a third party requires the prior written consent of springerle.net. Springerle.net will only withhold this consent for good cause.

Offsets of the customer are excluded, unless the counterclaim is legally established, ready for decision or undisputed. In addition, the customer may assert a right of retention against claims of springerle.net, if he is a merchant, only if it is based on undisputed, ready for decision or legally established claims from the same contractual relationship.

The purchase contract shall be governed exclusively by the substantive law of the Federal Republic of Germany to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

If the customer is a merchant, the local court of Reutlingen shall have exclusive jurisdiction for all disputes arising in connection with the performance of this contract and the place of performance shall be Reutlingen.
